Klage gegen aus unserer Sicht irreführende Aussendungen für einen Fair Guide

Das österreichische Verlagsunternehmen Construct Data Verlag GmbH mit internationalen Hintergrund macht fast auf der ganzen Welt Werbeaussendungen für die Eintragung in ein Online-Messe-Ausstellerverzeichnis mit der Bezeichnung „Fair Guide“. Aufgrund des engen zeitlichen Zusammenhangs mit dem jeweiligen Messetermin sowie der Aufmachung entsteht bei den Empfängern oft der unrichtige Eindruck, dass es sich hier auch bei Unterschrift um einen kostenlosen Eintrag und / oder Eintrag bzw. Aktualisierung für das offizielle Ausstellerverzeichnis des jeweiligen Messeveranstalters handelt, obwohl das vollständige Ausfüllen in Wahrheit kostenpflichtig ist und der Eintrag unmittelbar nichts mit der angeführten Messe oder deren Veranstalter zu tun hat.

Nach unserer Auffassung sind solche irreführend gestalteten Werbeaussendungen insbesondere aufgrund der strengen Rechtsprechung des Obersten Gerichthofes als unzulässig anzusehen. Construct Data versendet diese Angebote offensichtlich gezielt vor allem im Ausland und mahnt dort auch umfassend die Bezahlung bei irrtümlicher Unterschrift ein. Aufgrund der Vielzahl der Beschwerden und damit Beeinträchtigung der österreichischen Mitbewerber sowie des Ansehens der gesamten österreichischen Wirtschaft und auch der Schädigung österreichischer Firmen mit ausländischer Niederlassung ist vom Schutzverband Klage auf Unterlassung dieser aus unserer Sicht irreführenden Aussendungen und der Fruchtziehung daraus, also Verbot der Eintreibung dieser Forderungen, eingebracht worden.

Diese Intervention wegen unlauteren Wettbewerbs ist zunächst auf die Europäische Union sowie die Schweiz beschränkt, weil hier eine weitgehend einheitliche Rechtslage insbesondere aufgrund der Richtlinie über irreführende Werbung vorliegt. Bei einem positiven Ausgang dieses Verfahrens wird eine Ausdehnung auf andere Länder erfolgen.

Die Klage ist in erster Instanz mit der Begründung abgewiesen worden, dass der Schutzverband mangels Aussendungen an Unternehmer in Österreich nicht aktivlegitimiert ist, wobei wir wie oben ausgeführt sehr wohl eine Beeinträchtigung unserer Mitglieder sehen und Rechtsmittel einbringen werden. In diesem Sinne hat nun auch das OLG unserem Rekurs Folge gegeben und wird nun der OGH über die Frage der Aktivlegitimation zu entscheiden haben.

Die Intervention des Schutzverbandes kann jedenfalls nicht die zivilrechtliche Bestreitung des Anspruches durch die Unternehmer ersetzen, welche unterschrieben haben. Für die irregeführten Unternehmen würden wir daher empfehlen, Rechtsrat einzuholen, wobei aus unserer Sicht Irrtum geltend gemacht werden kann. Schließlich ist nach unseren Erfahrungen nach Bestreitung des Anspruchs offenbar bisher in keinem Fall von Construct Data geklagt worden.

Action against communications relating to a Fair Guide which we consider misleading

The Austrian publishing company Construct Data Verlag GmbH, which operates internationally, is sending out advertising communciations virtually worldwide for entry in an online fair exhibitors' directory bearing the name "Fair Guide". Because the timing of this communication is close to that of the respective fair date, and due also to the presentation, recipients often gain the false impression that, even when signed and submitted, this is a free entry and/or entry / update for the official exhibitors' directory of the respective fair organization, although completing the entry is in fact subject to a charge, and entry has nothing directly to do with the fair mentioned or its organizer.

In our view, such misleading advertising communciations must be viewed as inadmissible in particular on the basis of the strict judicial precedent of the Supreme Court. Construct Data apparently targets these offers primarily abroad, and there too always seeks to collect payment whenever a form is signed in error. Due to the large number of complaints and thus prejudice to Austrian competitors, as well as the reputation of the entire Austrian business community, and damage to Austrian companies with foreign establishments, the Schutzverband (Austrian Association against Unfair Competition) has instituted proceedings for an injunction against these communications – which we consider to be misleading - and the profits therefrom, i.e. a prohibition on the collection of payments.

This intervention in a matter of unfair competition is initially restricted to the European Union and Switzerland, because here the legal position is largely identical, in particular due to the Directive relating to misleading advertising. If the outcome of these proceedings is successful, they will be extended to other countries.

The action has been dismissed in the proceedings of first instance on the grounds that the Schutzverband, due to the fact that communications were not sent to businesses in Austria, does not have a right of action, although, as stated above, we do indeed perceive prejudice as regards our members and shall file an appeal. In no manner, however, was the content of the communications assessed or approved; the decision was purely one relating to formal requirements. The second instance now has followed our arguments and it is up to the Highest Court to decide if the Schutzverband has a right to action or not.

In any event, intervention by the Schutzverband cannot replace challenging of claims under civil law by those businesses which have signed up to the directory. With regard to those companies which have been misled, we would therefore recommend that legal advice be sought; in our view error can be asserted. In our experience it is the case that, following contestation of a claim, apparently in no case has legal action been taken by Construct Data.
